| 释义 | 海運 The conveyance of passengers or goods using ships or vessels as the mode of transportation. Carriage by sea is regulated by the common law applicable to carriers generally, by statute and by the terms of the contract of carriage. In Hong Kong, the law applicable to carriage by sea are: Carriage of Goods by Sea Ordinance (Cap 462), which applies the Hague Rules and states that the International Convention for the Unification of certain Rules of Law relating to Bills of Lading signed at Brussels and its Protocol shall have the force of law and; Merchant Shipping (Limitation of Shipowners Liability) Ordinance (Cap 434), which states that the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea 1974 has the force of law in Hong Kong. The period of ‘carriage of goods’ by sea envisaged in Hague-Visby Rules art II should not be strictly construed, limiting to ‘events arising from loading to discharge to when the goods are handed over to land carrier’: Wily Products Co Ltd v Hecny Shipping Ltd [1995] 3 HKC 47.
