释义 | 整體合約 A contract in which the parties have agreed expressly or impliedly that complete performance by the plaintiff is a condition precedent to the recovery of the contract price: Cutter v Powell (1795) 101 ER 573, 6 TR 320. Whether or not a contract is entire is a question of construction: Appleby v Myers (1867) LR 2 CP 651. Where a contract is entire and the condition precedent has not been fulfilled, the contract price will not be recoverable: Sinclair v Bowles (1829) 9 B & C 92. A contract can be entire with respect to some obligations but not with respect to others, and thus the expression ‘entire obligation’ may be substituted for entire contract.
