释义 | 法定仲裁 Arbitration of a dispute otherwise than by an agreement between the parties to arbitrate. A statute may provide that any dispute must be settled by arbitration: for example Telecommunications Ordinance (Cap 106) s 14(5)(b). A court may be empowered by statute to refer to arbitration some issues or the whole dispute being litigated before it. In applying the Ordinance to a statutory arbitration, a right to proceed to arbitration is to be treated in the same way as a cause of action would be treated if the proceedings were before a court: Pegler v Railway Executive [1948] AC 332, 1 All ER 559 (HL).
