释义 | 淫褻誹謗 Formerly, material which has the tendency ‘to deprave and corrupt those whose minds are open to such immoral influences, and into whose minds are open to such immoral influences, and into whose hands a publication of this sort may fall’: R v Hicklin (1868) LR 3 QB 360. The publication of any obscene libel is an offence punishable at common law on indictment: R v Wilkes (1770) 4 Burr 2527. The test of obscenity for obscene libel is whether the tendency of the matter charged as being obscene is to deprave and corrupt those whose minds are open to such immoral influences and into whose hands a publication of this sort may fall: R v Hicklin, supra. It is only necessary to prove, in respect of a charge of obscene libel, an intent to publish an article which was in fact obscene: Whitehouse v Gay News Ltd [1979] AC 617, sub nom R v Gay News Ltd [1979] 1 All ER 898 (HL). A book is not necessarily obscene merely because it is in bad taste or undesirable: R v Martin Secker and Warburg Ltd [1954] 2 All ER 683, 1 WLR 1138.
