释义	買方自慎 Lat – let the buyer beware. The principle that the buyer must ascertain the good quality of the goods he or she purchases. It provides a defence to a seller that the inspection ought to have revealed: Thornett & Fehr v Beers & Sons [1919] 1 KB 486, or where the buyer does not rely on the seller’s skill of judgment to ensure that a product is fit for an express or implied purpose: Baldry v Marshall [1924] All ER Rep 155, [1925] 1 KB 260. It does not mean in law or Latin that the buyer must take a chance, it means that he must take care and it applies to the purchase of specific things: Halsbury’s Laws of England, Vol 41 para 691. For example, for the sale of land, the general caveat emptor rule applies and patent defects in title can be thrust upon the purchaser for which a vendor is under a duty to disclose any latent defects, namely encumbrances and other adverse matters that are not reasonably discoverable by a purchaser upon an inspection: Green Park Properties Ltd v Dorku Ltd [2000] 2 HKLRD 400.
