Whether the forum chosen is the most appropriate one depends on (1) whether the forum is the appropriate forum for the trial; (2) particular attributes of the forum; (3) whether there is exorbitant exercise of jurisdiction; and (4) the issuance of the writ: Halsbury’s Laws of Hong Kong, Vol 7, Conflict of Laws [100.006]; Vol 5, Civil Procedure [90.0202] note 5. It is for the plaintiff to show that the forum chosen is the most appropriate forum for the trial and for the determination of the issues involved in the dispute: Amin Rasheed Shipping Corp v Kuwait Insurance Co, The Al Wahab [1983] 2 All ER 884, [1984] AC 50 (HL).
