| 释义 | 道德上的卑鄙行為 Conduct which is evil or has an element of moral depravity: Felix v General Dental Council [1960] AC 704, 2 All ER 391 (PC). It was once thought to be necessary for a finding of infamous conduct in a professional respect on the part of a professional person that the conduct demonstrates some element of moral turpitude or obliquity. The applicable test for ‘unprofessional conduct’ is incorporated in statute, for example ‘an act or omission of a registered dentist which would be reasonably regarded as disgraceful or dishonourable by registered dentists of good repute and competency’: Dentists Registration Ordinance (Cap 156) s 18(2). This test is indicative of moral turpitude: Dr Lam Kwok Pun v Dental Council of Hong Kong (CACV 137/2000, unreported). In every allegation of professional misconduct involving an element of moral turpitude it is the duty of the domestic professional tribunal investigating the allegations to apply a high standard of proof and not to condemn on a mere balance of probabilities: Bhandari v Advocates Committee [1956] 3 All ER 742, 1 WLR 1442 (PC).
