An instrument used to remit money to the named payee, often used by persons who do not have a cheque account relationship with a financial institution, to pay bills or to transfer money to another person or to a company. There are three parties to a money order; the remitter (payer), the payee and the drawee. A money order is not a negotiable instrument: Fine Arts Society Ltd v Union Bank of London Ltd (1886) 17 QBD 705. A money order or postal order can be an ‘instrument’ within the meaning of the Crimes Ordinance (Cap 200) s 68(1). Money orders for payment in a place outside Hong Kong may be issued by the Postmaster General: Post Office Regulations (Cap 98A) reg 19. See also Cheque; Cheque book.
