In building and construction law, the party who engages the contractor, being the person for whom the engineering or building works are done. The proprietor is often called the ‘owner’, ‘employer’, ‘client’ or ‘principal’. The proprietor is commonly the owner of the land on which the structure is erected. Although the proprietor is the party who engages the contractor, their relationship is not that of employer and employee. 3. In relation to industrial undertaking or notifiable workplace, the person for the time being having the management or control of the business carried on in such industrial undertaking or notifiable workplace and includes a body corporate and a firm and also the occupier of any industrial undertaking or notifiable workplace and the agent of such occupier: Factories and Industrial Undertakings Ordinance (Cap 59) s 2(1).
