An equity binding the owner of property who induces another person to assume or expect that an interest in that property will be obtained by or conferred on that person, where that person relies on that assumption or expectation and alters their position to their detriment: Bestkey Development Ltd v Incorporated Owners of the Mansion & Anor [1999] 3 HKC 275 (CA). Proprietary estoppel as a ground for resisting the claim of legal owner to deprive the partner or co-habitee of the beneficial interest of the property is now considered very akin to the principle of constructive trust. There must be a clear and unequivocal representation made by the plaintiff to the defendant: Lea Tai Property Development Ltd v Incorporated Owners of Leapoint Industrial Building [1996] 1 HKC 193 (CA). Whether the principle is called proprietary estoppel, estoppel by acquiescence or estoppel by encouragement has been said to be really immaterial: Kung Wong Sau Hin v Sze to Chun Keung [1996] 2 HKC 616; Ton Tim Nui v Hong Kong Housing Authority [1999] 4 HKC 466 (CA).
