释义 | 受屈 In order to bring proceedings successfully, a plaintiff or applicant must show he or she is entitled to bring the matter before the court and the court has power to determine the issue. A right of appeal against an administrative or judicial decision is usually conferred to a ‘person aggrieved’: Town Planning Ordinance (Cap 131) s 17B, or a person who claims to be or feels aggrieved. A person is not aggrieved by a decision if that decision is not materially adverse to him or her or if the tribunal to which he or she seeks to appeal has no jurisdiction to find in his or her favour: R v Cumberland Justices, ex p Hepworth (1931) 95 JP 206 (CA); Lee Miu Ling & Anor v A-G (No 2) (1995) 5 HKPLR 585 (CA).
