释义	蓄意的作為 In tort law, deliberately and voluntarily doing an act which causes an injury to another, or acting so recklessly that intention can be imputed. An international act is an essential element of torts to the person or property, and of actions on the case. If a defendant did not intend the act which interfered with a plaintiff’s rights, no intentional tort has been committed: Oriental Daily Publisher Ltd & Anor v Ming Pao Holdings Ltd & Ors [1999] 4 HKC 354 (CFI); Ho Ping Kwong v Chan Cordelia [1989] 2 HKC 415 (HC). The onus of proof lies on the plaintiff, who must plead that the act was intentional: Letang v Cooper [1964] 2 All ER 929, [1965] 1 QB 232 (CA).
