释义 | 證據權重 The exact degree of probative force of an item of evidence. The greater the degree to which an item of evidence tends to prove a fact in issue, the greater its weight: R v Stephenson [1976] VR 376. The weight to be given to a particular item of evidence is a matter of fact which will be decided, largely on the basis of common sense, in the light of the circumstances of the case and of the views formed by the jury (or the judge where there is no jury) on the reliability and credibility of the witnesses and exhibits: Halsbury’s Laws of Hong Kong, Vol 12, Evidence [175.027]. Frequently, a conclusion on the facts will decide a case one way or another and the burden of proof has no part to play in the resolution of evidential conflict, although it may be the determining factor if evidence is non-existent or evenly balanced: Re Barrell Enterprises [1972] 3 All ER 631, [1973] 1 WLR 19 (CA); Bratty v A-G for Northern Ireland [1963] AC 386, [1961] 3 All ER 523 (HL).
