| 释义 | 支撐權 The common law right of an owner of land to have the land physically supported by the land of an adjoining owner. The owner of land has ex jure naturae, as an incident of his or her ownership, the right to prevent such use of the neighbouring land as will withdraw the support which the neighbouring land naturally affords to his or her land: Dalton v Angus (1881) 6 App Cas 740. In the natural state of land one part of it receives support from another, upper from lower strata, and soil from adjacent soil and therefore if one piece of land is conveyed so as to be divided in point of title from another contiguous to it, the right to support passes with the land, not as an easement held by a distinct title, but as an essential incident to the land itself: Dalton v Angus, supra. Although the right does not entitled the owner to insist upon the neighbouring land remaining in its natural state, the right is infringed as soon as damage is sustained in consequence of the withdrawal of that support: Wong Sai Ying v Wong Tsung Koo (1911) 6 HKLR 92. The owner of land has no natural right to support for buildings or for the additional weight which the buildings causes: Elliot v North Eastern Rly Co (1863) 10 HL Cas 333 (HL).
