In contract law, a type of damage involving disappointment or distress suffered by a person as a result of a breach of a contract to provide entertainment, recreation, relaxation, or enjoyment. Generally, a person may not recover damages in contract for disappointment or distress, due to consideration of policy: Watts & Anor v Morrow [1991] 4 All ER 937, 1 WLR 1422 (CA); Mohammed Yaqub Kham v A-G [1990] 1 HKLR 421 (HC). However, an award of damages for loss of enjoyment may be made for the breach of the terms of a contract such as a contract for a holiday or other similar leisure pursuit, the purpose of which was to provide enjoyment or avoid distress: Watt v Morrow, supra. Loss of enjoyment is covered by loss of amenities in personal injuries actions: Chun Yat Nam v A-G (CACV 92/94, unreported). See also Entertainment; Non-pecuniary loss.
