释义 | 無合理疑點的證明 The onus of proof normally borne by the prosecution in a criminal proceeding: R v Robertson [1968] 3 All ER 557, 52 Cr App Rep 690 (CA); Woolmington v DPP [1935] AC 462, 25 Cr App Rep 72 (HL). This standard is also requisite in cases of committal for contempt: Re Bramblevale Ltd [1970] Ch 128, [1969] 3 All ER 1062 (CA). It is not necessary for any particular form of words to be used to convey this standard to a jury, provided that the jury is made to appreciate the substance of the test: Ferguson v R [1979] 1 All ER 877, 1 WLR 94 (PC). Proof beyond a reasonable doubt does not mean proof to a scientific certainty: R v Yeung Kuen Chi [1985] 2 HKC 163. Once a matter is established beyond reasonable doubt it must be taken for all purposes of law to be a fact, as there is no room for a distinction between what is found by inference from the evidence and what is found as a positive fact: Re Barrell Enterprises [1972] 3 All ER 631, [1973] 1 WLR 19 (CA).
