Where the injured plaintiff has not at the date of trial sustained a loss of or reduction in his earnings, he may still claim an award of damages if his injuries make it more likely that he will lose his job and that any job he may subsequently find will be less well paid: Chan Wai Tong v Li Ping Sum [1985] HKLR 176; Lau Ho Wah v Yau Chi Biu [1984] 1 HKC 581 (CA). In order for damages to be recoverable under this head, there must be a real or substantial risk of the plaintiff losing his job at some point in his future: Kings Light Industrial Ltd v Lo Wai Keung (CACV 80/92, unreported); Sui Wai Man v Lee Chi Chong [1999] HKLRD E10. Such an award is to compensate the plaintiff for the weakening of the competitive position in the open labour market: Smith v Manchester Corp (1974) 17 KIR 1, 118 Sol Jo 597 (CA). In assessing this head of damage, the court will consider whether there is a real risk that the plaintiff will be forced onto the labour market before retirement age; the extent of his injury or disability; how long it would take him to find alternative employment if forced onto the labour market; the reduction in salary which he would suffer thereby: Halsbury’s Laws of Hong Kong, Vol 22, Remedies [340.202].
