释义 | 威嚇性的 Lat – in fear of dread; intended to frighten or intimidate. In succession law, a mere idle threat to induce a beneficiary of personal property in a will to comply with the conditions thereof stipulated. Such conditions in terrorem may be void unless there is a gift over but not to affect the gift. For example, a bequest conditional on the legatee not contesting the will (Re Gaynor [1960] VR 640) or a bequest conditional in partial restraint of marriage (Bellasis v Ermine (1663) 1 Cas in Ch 22).
