| 释义 | 租住者 A person who occupies a room or rooms in a house which is generally under the control of the owner or lessee of the house, or his representative. The owner of the house has retained to himself the occupation, even though he has agreed to give the exclusive enjoyment of the occupation to the lodger: Street v Mountford [1985] AC 809, 2 All ER 289 (HL). This is so although the lodger has the exclusive use of rooms, and though his goods are stowed there. A lodger without separate apartment is only a licensee: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.017]. Even where he has a separate apartment, if the landlord retains the general control and dominion of the house including the part occupied by the lodger so as to prevent the lodger from having exclusive possession, the lodger is in the position of a licensee only: Lam Man Yuen v Lucky Apartments [1964] HKLR 689; Wing Hing Oil Co Ltd v Director of Buildings and Lands [1988] HKDCLR 25. However, if the landlord has no control over that part, the occupier is a tenant. The occupier does not become a lodger merely because the landlord resides on the premises and retains control of the passages and staircases and other parts used in common: May King Development Co Ltd v Anor v Young Ching Huo Ltd [1981] HKLR 280 (HC).
