释义 | 信譽的損失 A form of non-pecuniary loss recoverable caused by social discredit or damage to a person’s status, name or character. Reputation can be protected by the tort of defamation. Loss of reputation will depend upon a person’s status in society. The higher the status, the greater the damage likely to be presumed: Wong Melvin v Jockey Daily News Ltd & Anor [1985] 2 HKC 528 (HC); Kan Chung Nin Tong v Li Kwong Ming [1987] 1 HKC 487 (HC). As regards the quantum of damages, ideas change from age to age and from country to country: Cheung Suk Man v So Shek Keung [1965] HKLR 485. Where the injury to the plaintiff’s credit or reputation was within the presumed contemplation of the parties as likely to result from a breach of contract, damages may be awarded for the injury: Halsbury’s Laws of Hong Kong, Vol 22, Remedies [340.344].
