| 释义 | 有待審訊的真正問題 An issue of substance that requires judicial clarification. A real question to be tried might be one of fact or law: Dey v Victorian Railways Cmrs (1949) 78 CLR 62. The phrase is also analogous to ‘triable issue’. Where there is a triable issue on a question of fact, it is unlikely that the court will intervene and decide that there should be no trial: European Asian Bank AG v Punjab and Sind Bank (No 2) [1983] 2 All ER 508, 1 WLR 642 (CA). When a plaintiff applies for summary judgment, it is for the defendant to show that there is a triable issue or an arguable defence if he is to be granted leave to defend: Manciple Ltd v Chan On Man [1995] 3 HKC 459.
