释义 | 押後申請 1. The request or motion of one party for an adjournment or postponement of a session, hearing, trial, or other proceedings to a subsequent day or time. The entry of a continuance is made on the court record to formally evidence the postponement: O’Brien v R (1890) 26 LR Ir 451. 2. In civil proceedings, an application for an adjournment should be made as soon as the necessity for the adjournment arises, otherwise it may be granted only on terms as to costs and, if not promptly made, it may be refused with costs: The Rules of the High Court (Cap 4A) O 62 r 8(1). An adjournment may be refused where such would result in prejudicial delay and unwarranted loss of judicial time: Wellfit Investments Ltd v Poly Commence Ltd [1995] 3 HKC 56 (CA). 3. In criminal proceedings, adjournments are not granted merely for the asking, still less upon an unreasoned and unjustified demand and the community is entitled to expect that criminal cases – especially serious ones – will be disposed of promptly: R v Wong Wai (HCMA 517/96, unreported).
