| 释义 | 預付財產條款 Specific powers given to a trustee within the trust document by which capital can be applied for the advancement or benefit of any person entitled to the trust property. If the testator has attempted to creat a perpetuity (a condition extending the inalienability or property beyond the time of a life or lives in being plus 21 years), the courts, instead of declaring the devise to be void, will endeavour to carry out the testator’s general intention as far as the rule (against perpetuities) will allow: Pilkington & Anor v Inland Revenue Cmrs & Ors [1962] 3 All ER 622, [1964] AC 612 (HL).
