释义 | 不當的行為 Behaviour which in all the circumstances of case is an inappropriate or incorrect way of discharging duties, obligations and responsibilities. Conduct may be improper regardless of whether it is conscious or unconscious. Improper conduct is a breach of the standards of behaviour which would be expected of a person by reasonable people with knowledge of that person’s duties, powers and authority and the circumstances of the case. It may be improper conduct for a barrister to withdraw from the case without the consent of the client, after accepting a brief for an agreed fee for a trial of an action: Re a Barrister [1966] HKLR 181. ‘Unlawful or seriously improper conduct’ extended beyond criminal conduct to include civil wrongs: Tse Lai Yin Lily & Ors v Incorporated Owners of Albert House & Ors [1999] 1 HKC 386 (CFI).
