| 释义 | 無罪的代理人 A person participating in a crime but lacking criminal responsibility because he or she is either insane or too young to understand: R v M’Naghten (1843) 10 Cl & Fin 200 (HL); C (A Minor) v DPP [1996] AC 1 (HL). A person who uses an innocent agent to commit a crime is liable as a principal offender: R v Cogan & Leak [1976] 1 QB 217 (CA); R v Ng Kam Wah & Ors [1993] 1 HKCLR 163 (CA). Where the conspiracy formed outside but act in furtherance of conspiracy committed in Hong Kong by innocent agent, under common law the Hong Kong courts have jurisdiction over the offence: A-G v Yeung Sun Shun & Anor [1987] 2 HKC 92, HKLR 987 (CA).
