释义 | 逃避的途徑 A way in which a person may reasonably avoid being falsely imprisoned. The tort of false imprisonment is based on the principle of total confinement within boundaries set by defendant. Where there is partial restraint on the plaintiff’s movement, there cannot be false imprisonment if the means of escape available to the plaintiff is reasonable. In other words, there will be no false imprisonment if the plaintiff could conveniently take another route: Bird v Jones (1845) 7 QB 742; Srivastava & Tennekone The Law of Tort in Hong Kong, ch 5, pp 59-62.
