| 释义 | 家庭供養申請 An application to the court by a person with locus standi for family provision under the Inheritance (Provision for Family and Dependants) Ordinance (Cap 481). Persons who may make such application are spouses, former spouses, tsips or male partners, children whether adult or infant, persons who are treated as children of the deceased and are being maintained, either wholly or substantially, by the deceased, brothers and sisters and any other person who immediately before the death of the deceased was being maintained, either wholly or substantially, by the deceased: Inheritance (Provision for Family and Dependants) Ordinance (Cap 481) s 3. In exercising its jurisdiction to make provision for an applicant, the court will consider whether the will and/or the disposition of the deceased’s estate have made reasonable provision for the applicant: s 5. The court may make orders for periodical payments or a lump sum payment to the applicant out of the net estate of the deceased person. The court may also make orders for the transfer of property to the applicant, orders for the settlement for the benefit of the applicant of such property comprised in that estate and/or orders for the acquisition out of property comprised in that estate of such property: s 4. See Family Provision. 根據《財產繼承（供養遺屬及受養人）條例》（第481章）就家庭供養而言具有出庭資格人向法院作出的申請。可作出此等申請的人包括死者的配偶；仍未再婚的前妻或前夫；妾侍或男方；幼年子女或成年子女，而在緊接死者去世前，該子女是完全或主要靠死者贍養的；兄弟姊妹及任何其他人，而在緊接死者去世前，該兄弟或姊妹是完全或主要靠死者贍養的：《財產繼承（供養遺屬及受養人）條例》 （第481章）第4條。在行使司法管轄權向申請人作出供養時，法院須考慮死者遺囑及/或作出的遺產處置，有否為申請人提供合理經濟給養：第5條。法院可作出命令，命令從死者淨遺產中按照所指明的定期款額或所指明款額的款項整筆支付給申請人。法院亦可作出命令，命令將所指明屬該淨遺產一部分的財產轉移給申請人、對所指明屬該淨遺產一部分的財產，為申請人的利益作出授產安排、及/或從屬該淨遺產一部分的財產中取出所指明的財產，並將所取得的財產轉移給申請人：第4條。另見 Family Provision。 |
