释义 | 現有科技 The state of scientific and technical knowledge in relation to a product at a particular date: Merrell Dow Pharmaceuticals Inc v H N Norton & Co Ltd and Penn Pharmaceuticals Ltd (1995) 33 IPR 1. In relation to patents, the state of the art shall be held to comprise everything made available to the public (whether in Hong Kong or elsewhere) by means of a written or oral description, by use, or in any other way: (a) before the deemed date of filing of an application for a standard patent for the invention or, if priority was claimed, before the date of priority; or (b) before the date of filing of an application for a short-term patent for the invention or, if priority was claimed, before the date of priority, whichever is the earlier: Patents Ordinance (Cap 514) s 94(2). For a product to be considered new and patentable under the Patents Ordinance, it must add to or divert from the existing state of the art: s 94(1). 關於科學及技術知識在特定日期的狀態:Merrell Dow Pharmaceuticals Inc v H N Norton & Co Ltd and Penn Pharmaceuticals Ltd (1995) 33 IPR 1。就專利而言,現有科技須視作藉書面或口頭的說明、藉使用或以任何其他方法在以下日期前提供予在香港或其他地方的公眾人士的一切事物:(a) 就有關發明而提出的標準專利的申請的當作提交日期,如有人聲稱具有優先權,則為優先權的日期;或(b) 就有關發明而提出的短期專利的申請的提交日期,如有人聲稱具有優先權,則為優先權的日期,兩者以較早者為準:《專利條例》(第514章)第94(2)條。如任何發明如並不構成現有科技的一部分,則可根據專利條例被考慮成為新穎的及可享專利的產品:第94(1)條。 |
