A clause in a contract of marine insurance under which an insurer agrees to indemnify the insured against damages which the insured becomes liable to pay as a result of a collision. A collision clause usually requires the insurer to pay 75 % of the total liability incurred by the insured. The collision clause is a separate contract operating over and above the contract of insurance: Adelaide Steamship Co Ltd v A-G [1926] AC 172. A collision clause only operates when the insured vessel is at fault and the insured becomes liable to pay tortious damages, but not contractual damages: Furness Withy & Co Ltd v Duder [1936] 2 All ER 119, 2 KB 461. Where a collision is caused by the negligence of both ships, the liability is apportioned according to the degree to which each ship was at fault: The Maloja II [1993] 1 Lloyd’s Rep 48.
