| 释义 | 訟費轉嫁令 A court order to an unsuccessful defendant to pay the costs to the successful defendant, where an action is properly and reasonably brought against two or more defendants as being liable severally or in the alternative and judgment is recovered against one only: Bullock v London General Omnibus Co [1904-1907] All ER Rep 44, [1907] 1 KB 264 (CA); Leung Lai Ha v Hon Sau Ling & Anor [1992] 2 HKC 109 (CA). Such an order is discretionary: Hong v A & R Brown Ltd [1948] 1 KB 515, 1 All ER 185 (CA). When ordered the court may direct the plaintiff to pay the successful defendant’s costs and recover them from the unsuccessful defendant or it may direct the unsuccessful defendant to pay them direct to the successful defendant: Sanderson v Blyth Theatre Co [1903] 2 KB 533. An order against the unsuccessful defendant giving the plaintiff his ‘costs of the action’ was held to include his costs incurred in pursuing his claim against the successful defendant: Kelly’s Directories Ltd v Gavin and Lloyds [1901] 2 Ch 763 (CA). An unsuccessful defendant should not be ordered to pay the costs of an issue raised by other defendants where he has admitted the facts in his defence: Donovan v Walters (1926) 135 LT 12 (CA).
