| 释义 | 固有的司法管轄權 An inherent power of a court exercising judicial functions to regulate its own practice and procedure, save insofar as its procedure has been laid down by the enacted law: Connelly v DPP [1964] AC 1254, 2 All ER 401 (HL). The inherent jurisdiction of the court enables it to exercise (1) control over court process by regulating its proceedings (Lau Tang Su Ping May v Lau Chu [1988] HKC 128 (CA)), by preventing abuse of process (R v Soo Fat Ho [1992] 2 HKCLR 114 (CA)) and by compelling the observance of the process; (2) control over persons who appear before the court whether as litigants, lawyers or an amicus curiae; and (3) control over the powers of inferior courts and tribunals. A court cannot, however, adopt a practice or procedure contrary to or inconsistent with rules laid down by statute or adopted by ancient usage: The Board of Trustees of Chung Chi College & Anor v Chanway Investment Co Ltd [1993] 1 HKLR 203 (CA)).
