释义 | 訴訟因由的不容反悔原則 The principle that an individual is prohibited from denying or alleging a fact because of that individual’s previous conduct allegation or denial. Primarily, it is to prevent the abuse of the court process: Kwan Chui Kwok Ying v Tao Wai Chun [1995] 1 HKC 374. The cause of action estoppel arises when the same parties having involved in the same matter in a legal proceeding and the cause of action and the subject matter in a later proceeding between the same parties are identical to the earlier one. Parties are normally not allowed to open the same subject of litigation for the matters which should have been but have not been brought forward to the court for reason of the parties’ negligence or inadvertence: Collin Navigation Co SA v Perusahaan Pertambangan Minyik Dan Gas Bumi Negara (Pertamina) [1986] HKC 78.
