释义 | 案件管理 An approach to the control of litigation in which the court assumes responsibilities for the progress of cases through pre-trial stages in order to ensure that court resources are deployed appropriately and court backlogs and delays are reduced. Case management devices include judges attempting to reduce prolix advocacy; widespread introduction of skeleton arguments, lists of authorities and chronologies; requirement for the exchange of witness statements together with an order that witness statements shall stand as evidence in chief; provision for split trials in personal injury actions; introduction of special lists, special provisions for long trials; and fixing a timetable for the trial. Also known as ‘case review’, ‘caseflow management’, ‘caseload management’, ‘differential case management’, ‘judicial management’.
