释义 | 人身不可侵犯 Complete protection of a person from interference with the person’s life, body, residence, vehicle, or communications. Diplomatic personnel are granted inviolability of person by virtue of international law. The host state is obliged to provide such protection by taking appropriate steps to ensure that the freedom or dignity of a diplomatic person remain inviolable: Vienna Convention on Consular Relations 1963 art 40; Vienna Convention on Diplomatic Relations 1961 art 29. This requirement is recognised in the People’s Republic of China by virtue of the Regulations of the People’s Republic of China Concerning Diplomatic Privileges and Immunities (05/09/1986) art 12 (made applicable to the Hong Kong SAR by inclusion in the Annex III (04/04/1990) and implemented through promulgation by the Chief Executive under the Basic Law art 18 (Promulgation of National Laws 1997 (LN 379/1997)) and the Regulations of the People’s Republic of China Concerning Consular Privileges and Immunities (30/10/1990) art 12 (made applicable to the Hong Kong SAR by inclusion in the Annex III of the Basic Law (04/04/0990) and implemented through promulgation by the Chief Executive under the Basic Law art 18 (Promulgation of National Laws 1997 (No 2) (LN 386/1997)). 全面保護人員生命、身體、寓所、車輛、通信不受干擾。國際法賦予外交人員人身不可侵犯的權利。接受國有義務通過採取一切適當步驟以防止外交人員人身、自由或尊嚴受有任何侵犯來提供這種保護:《維也納領事關係公約》第40條;《維也納外交關係公約》第29條。此義務規定于《中華人名共和國外交特權與豁免條例》(1986年9月5日)第12條(該法包括在《中華人民共和國香港特別行政區基本法》附件三之內而適用於香港特別行政區,其通過特別行政區長官依據基本法第18條公佈(Promulgation of National Laws 1997(LN 379/1997))得以實施)和《中華人名共和國領事特權與豁免條例》(1990年10月30日)第12條(該法包括在《中華人民共和國香港特別行政區基本法》附件三之內而適用於香港特別行政區,其通過特別行政區長官依據基本法第18條公佈(Promulgation of National Laws 1997(No.2)(LN 386/1997))得以實施)。 |
