The notion of public benefits necessarily involves a subjective perception and appraisal on the part of the decision-maker as to what is beneficial to the community, and public benefit has a wider compass than public need: Society for Protection of the Harbour Ltd v Town Planning Board [2003] 4 HKC 463. The question of whether publication was for the public interest is for the jury to decide. 2. In the law of charitable trusts, an essential requirement of a charitable trust; it must be directed to the public benefit. The benefit that is offered to a group of ascertained or ascertainable people: Astor's Settlement Trusts, Re, Astor v Scholfield [1952] Ch 534; Re Lipinski’s Will Trusts, Gosschalk v Levy [1976] Ch 233. Public benefit must involve a direct benefit: A-G v Terry (1874) 9 Ch App 423. Unless the contrary appears in the trust instrument, a public benefit is presumed to exist in trusts for the relief of poverty and for the advancement of education and religion, but must be affirmatively proved in trusts stated to be for the benefit of the community: National Anti-Vivisection Society v IRC [1948] AC 31.
