释义 | 須有基本意圖的刑事罪 An offence at common law or under statute in which the mens rea of the offence is an intention to commit the very act or omission which gives rise to the offence. That is, an offence where the mens rea does not extend past the act committed and its consequence: R v Morgan [1976] AC 182 (HL); R v Majewski [1977] AC 443, [1976] 2 All ER 142 (HL). The distinction between a crime of basic intent and one of specific intent is significant in relation to the relevance of self-induced intoxication to the question of the guilt of an accused. 違反犯普通法或法規的犯法行為,而這種犯法行為所有的犯罪意圖是,有意圖干犯正正是構成罪行的作為或不作為。即是說,所指的罪行,其犯罪意圖並不超越有關的犯罪行為和它造成的後果: R v Morgan [1976] AC 182(上議院); R v Majewski [1977] AC 443, [1976] 2 All ER 142(上議院)。須有基本意圖的刑事罪和須有特定意圖的刑事罪兩者之間分別,對被告自我引發醉酒能否關連被告可入罪的問題,有很大關係。 |
