| 释义 | 創造性 The necessary quality of ingenuity evident in a patentable invention. In order to be patentable, an invention must involve an inventive step. An invention shall be considered as involving step if, having regard to the state of the art, it is not obvious to a person skilled in the art: Patents Ordinance (Cap 514) s 96(1). The question of the inventive step is whether what is claimed is so obvious that it would at once occur to anyone acquainted with the subject, and desirous of accomplishing the end.
