释义 | 安樂死 Gk – a good death. Easy death, mercy killing of terminally ill person, or a person who does not wish to continue living. Euthanasia may be ‘active’ (actively assisting a person to die, or causing death), or ‘passive’ (not acting to prolong life). It may also be ‘involuntary’ (a killing of a person in order to relieve pain and suffering), or ‘voluntary’ (the killing of a person with their consent). All killing in Hong Kong must be unlawful and not justifiable or excusable for all practical purpose unless the person kills by misfortune, or in self-defence or lawfully in any manner under the Offences Against the Person Ordinance (Cap 212) s 8. Moreover, under common law, the motive for a killing is not relevant to its lawfulness, euthanasia is therefore not lawful: Airedale NHS Trust v Bland [1993] AC 789, 1 All ER 821 (CA), 2 WLR 316 (HL). The mere fact that a person consents to their own death is no defence to a charge of murder, so it remains an offence to aid, abet, counsel or procure the suicide of another: Offences Against the Person Ordinance (Cap 212).
