| 释义 | 第三者保險 1. A contract of insurance where the insurer undertakes to indemnify the insured against liability to third parties. When a company, which is insured against liabilities to third parties, is wound up whether compulsorily or voluntarily, the company’s rights against the insurer in respect of that liability are transferred to, and vested in, the third party: Third Parties (Rights Against Insurers) Ordinance (Cap 273) s 2(1). If the insurer’s liability to the company is less than the company’s liability to the third party, the third party may prove in the liquidation for the balance: s 2(4)(b). Where the insurance company is wound up, third party claimants in respect of personal injury and death whose claims have not been liquidated by judgment or settlement are not entitled to prove in the insolvent liquidation of the insurance company because their claims arise by virtue of the Motor Vehicles Insurance (Third Party Risks) Ordinance and otherwise than by reason of contract. In that case, third party claimants are entitled to claim directly against the insurance company if it becomes solvent: Re Singapore Insurance Co Ltd [1985] 2 HKC 244. 2. A contract of insurance in which a third party has an interest. For example, where the insured acts as the third party’s agent for the purpose of obtaining the insurance, the insured holds the benefits of the insurance on trust for the third party: Vandepitte v Preferred Accident Insurance Corp of New York [1933] AC 70.
