| 释义 | 未婚父母 A person who has the sole care of a child but who is not in a de facto relationship or marriage with the other parent and was not at the time of the child’s birth. At common law, an unmarried mother may claim custody of her illegitimate child: Barnado v McHugh [1891] AC 388 (HL). An unmarried mother will have the same rights and authority as she would have if the minor were legitimate: Guardianship of Minors Ordinance (Cap 13) s 3(1)(c)(i). An unmarried father only has such rights and authority, if any, as may be ordered by a court on an application brought by the father: s 3(1)(c)(ii).
