| 释义 | 非法逮捕 The apprehension or detention of a person that breaches the statutory or common law requirements for lawful arrest. Where a constable arrests a person, but is unable to establish that the arrest was made on reasonable suspicion that the person arrested had committed an offence, he may be liable for making an unlawful arrest: A-G & Ors v Ho Shek-Kwan [1980] HKLR 64, 1 HKC 294 (CA). If an arrest is unlawful at the outset or became unlawful, it may become lawful if circumstances change to render it lawful: Lewis v Chief Constable of the South Wales Constabulary [1991] 1 All ER 206 (CA). Thus, for example, if the arrest becomes unlawful by reason of the failure to give reasons to the arrested person for the arrest, the arrest may subsequently become lawful if reasons are given later: R v Chan King-hei [1995] 1 HKCLR 288, 2 HKC 681 (CA).
