| 释义 | 債務人本身的款項 The money or property of a debtor available to pay the debtor’s debts. Under Hong Kong law, if a company can pay its debts only with the help of loans made by others, it is nevertheless prima facie able to pay its debts: Re a Company [1986] BCLC 262. The fact that the company could only pay its debt with borrowed money did not show that it was unable to pay its debts: Companies Ordinance (Cap 32) s 77(1)(d); Re a Company, supra.
