释义 | 暴動 An indictable offence at common law which involves a tumultuous disturbance together with the presence of three or more persons with a common purpose, the execution or inception of the common purpose between them, an intent to help one another, by force if necessary, against anyone who may oppose them in the execution of their common purpose, and force or violence of such a nature as to alarm at least one person of reasonable firmness: Munday v Metropolitan Police District Receiver [1949] 1 All ER 337. Those who incite the riot are guilty of riot even though they are not present at the time of the actual riot: R v Caird (1970) 114 Sol Jo 652, 54 Cr App Rep 499 (CA). The offence of riot is also committed where a person taking part in an assembly, which is an unlawful assembly, commits a breach of the peace and in such a case the assembly is a riot and the persons assembled are riotously assembled: Public Order Ordinance (Cap 245) s 19(1).
