| 释义 | 非法取得之證據 Evidence obtained in contravention to the law, for example by an illegal search or seizure committed by police officers. At common law, the fact that evidence has been obtained illegally does not affect its admissibility: R v Sang [1979] 2 All ER 1222, [1980] AC 402 (HL); R v Ting Shui Ching & Ors [1966] HKLR 174; Lee Yin Ping v R [1979] HKLR 454 (HC). Such evidence is admissible but a court has a discretion to exclude the evidence upon the ground that its prejudicial effect outweighs its probative value. The same discretion applies to evidence obtained improperly although not through illegality: ITC Film Distributors v Video Exchange Ltd & Ors [1982] 2 All ER 241, 1 Ch 431. The person who has obtained such evidence may be restrained from using it by proceedings promoted by the owner of the evidence so obtained: Wong Kwok Hin v Wong Lai Fan (No 1) [2001] 3 HKC 656 (CFI).
