The constructive trust is able to be resorted to where the beneficiary has made some contribution to the purchase of the property, or by reference to a de facto relationship where the court has been unable to classify the interest of one party as other than binding in conscience: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0409]. Intention for this kind of trust is not a necessary ingredient: Re MW Lee & Sons Enterprises Ltd [1999] 2 HKC 686; Sun Sek Haw & Ors v Au So Kum [1999] 3 HKC 92. Such trust will often be contrary to the intention of constructive trustee. There must exist specific trust property. Equity will not use a constructive trust if the effect is to defect statutory provisions: Chan Yiu Tong v Wellmake Investments Ltd [1996] 1 HKC 528 (CA).
