释义	公共政策 1. A definite and governing principle under which contracts may be illegal or void: Halsbury’s Laws of Hong Kong, Vol 7, Contract [115.204]. Any agreement which tends to be injurious to the public or against the public good is invalidated on the grounds of public policy: Chan Cheuk-ting v Analogue Engineering Co Ltd [1986] HKLR 935 (CA); Innovisions Ltd v Charles Chan Sing Chuk [1992] 1 HKLR 71 (HC). The question whether a particular agreement is contrary to public policy is a question of law, to be determined like any other by the proper application of prior decisions. An agreement which tends to interfere with legislative process or with elections is contrary to public policy. 2. The interests of the community in general. Certain evidence may be excluded on the grounds that it is not in the public interest that it should be disclosed in court: R v Alexander Lau [1982] HKDCLR 53; Y Khan v P G O’Dea [1987] HKLR 150. For example, police officers and public officials may not be compelled to disclose the sources of their information, and witnesses for the state in public prosecutions may not be made to disclose the channel through which they have communicated information: R v Lam Kwok Hung [1989] 2 HKLR 182.
