释义 | 無償運輸 The carriage of passengers, their goods and the goods of others, other than for reward. A carrier undertaking gratuitous carriage remains subject to the liabilities of a carrier, but a lower standard of care is applied in determining the responsibility for loss or damage sustained in the course of gratuitous carriage: Port Swettenham Authority v T W Wu & Co (M) Sdn Bhd [1979] AC 580 (PC). The liabilities arising from the gratuitous carriage of passengers or cargo not performed by an air transport undertaking or by the Government, are governed by the ordinary law of negligence, which imposes separate relation to the condition of the aircraft, upon the owner and operator of the aircraft performing the carriage. They are under a duty to use reasonable care and skill in performing the carriage and, if the injury or loss is caused by the fault of the owner or operator or that of some person for whose actions they are vicariously responsible, they are liable for damage caused by any of this duty: Lewys v Burnett and Dunbar & Anor [1945] 2 All ER 555.
