| 释义 | 國際擄拐兒童 The wrongful removal of a child from one state to another; or the wrongful retention of child in a state. Such a removal constitutes abduction because it violates custody rights arising from the operation of law or court orders: The Hague Convention on the Civil Aspects of International Child Abduction 1980 art 3. This provision has been incorporated into Hong Kong law: Child Abduction and Custody Ordinance (Cap 512). A system of administrative and legal procedures to bring about the return of abducted children is embodied in the Convention on the Civil Aspects of International Children Abduction 1980. The common law offence of kidnapping a child under the age of 14 could be committed by a parent: R v D [1984] AC 778 (CA). 不當地把兒童從某一國家遷移至另一國家；或不當地扣留該名兒童在某一國家。該遷移因違反經法律運作或法庭命令產生的管養權而構成擄拐：1980年海牙《國際擄拐兒童民事方面公約》第3條。該條例已納入香港法例：《擄拐和管養兒童條例》（第512章）。《1980年國際擄拐兒童民事方面公約》編入了致令交還擄拐兒童的行政、法律程序系統。普通法下的綁架未滿14歲之兒童罪可由父親或母親觸犯：R v D [1984] AC 778（上訴法院）。另見《國際擄拐兒童民事方面公約》。 |
