| 释义 | 適合特定用途的程度 Capacity for use or consumption. In sale of goods law, the state of goods being reasonably fit for a particular purpose for they are purchased: Sale of Goods Ordinance (Cap 26) s 16(1), (2). Where a seller sells goods in the course of business and the buyer, either expressly or impliedly, makes known to the seller that the goods purchased are for a particular purpose, it is an implied condition that the goods being sold are fit for that purpose, except the circumstances show that the buyer dose not or it is unreasonably for him to rely on the seller’s skill and judgement: s 16(3). Such condition applies at the time of delivery.
