| 释义 | 定價合約 A building contract in which the contractor is required to complete the works for a lump sum, there being no “rise and fall” clause, and thus no provision to compensate the contractor for increases in labour and material costs. Commonly, building contracts provide for payment of an agreed sum with provision for adjustment of this sum. Adjustments may be made for variations to the work, extra costs incurred as a result of certain delays, or variations in the cost of the work for certain unexpected difficulties in performing it, such as latent ground conditions. This type of contract nonetheless is known as a ‘fixed price’ or ‘firm price’ contract. As a matter of principle a fixed price contract which sets out the scope of works, does not preclude liability for future additional works which fall outside the original scope and which are carried out much later than the original work: James Lau & Associates Ltd v Tom Ip & Partners Architects, Engineers and Development Consultants Ltd & Anor (HCCT 55/2000, unreported).
